TERMS & CONDITIONS:
Please read the following conditions carefully and in their entirety. You will be bound by these conditions if we carry or store goods and products for you.
This means that:
· You should take out your own insurance cover over the goods and products.
· If both you and the consignee are each operating a business:
- the goods will be at your sole risk and our services are priced on this basis; and
- we will not be liable for any loss of or damage to the goods, or any other losses you suffer whatsoever, regardless of the cause of such loss or damage.
1. MCDERMID’S TRANSPORT ‘N’ HEAVY HAULAGE, ABN 46452496725 (referred to as “the Carrier” hereinafter) which will include its servants, agents and sub-contractors. The Carrier is not a common carrier and will accept no liability as such. All goods carried or other services performed shall be subject only to these conditions of carriage and the Carrier reserves the right to accept or refuse the carriage of any goods at its discretion. The conditions contained herein are subject to change by the Carrier without prior notice.
2. The goods are at the risk of Consignor and not the Carrier and unless it is expressly agreed and writing. The Carrier shall not be responsible in tort of contract otherwise for any loss or damage to or deterioration of goods or mis-delivery or failure to deliver or delay in delivery of goods including chilled, frozen, refrigerated or perishable goods either in transit or in storage for any reason whatsoever including without limiting the foregoing the negligence or wilful act or default of the Carrier or others and this Clause should apply to all such loss of or damage to or deterioration of goods or mis-delivery or failure to deliver or delay in delivery of goods as aforesaid, whether or not the same occurs in the course of performance by the Carrier of the contract or in the events which are in contemplation of the Carrier and/or the Consignor or events which are foreseeable by them or either of them or in events which could constitute a fundamental breach of the contract or a breach of fundamental term thereof.
3. The Carrier shall not be bound by any Agreement purporting to vary these conditions unless such Agreement shall be in writing and signed by the Carrier Director.
4. The Carrier accepts no responsibility for any damage, including injury, delay or loss of any nature, arising out of or incidental to the carriage or any services ancillary thereof or which may occur at any time after the goods have been delivered to the Carrier and before the goods have been delivered to the Consignee whether due to alleged to be due to misconduct or negligence on the part of the Carrier or not and whether the cause of the damage is known or unknown to the Carrier.
5. It is agreed that the person delivering any goods to the Carrier for carriage is authorised to sign this consignment note for the Consignor.
6. Unless otherwise directed by notice in writing the Carrier is authorised by the Consignor to collect payment of the “C.O.D.” goods in legal tender or cheques and to give receipts on behalf of the Consignor.
7. Payments to the carrier are to be made upon receipt unless prior arrangements have been made and agreed by the Carrier.
8. If on demand any person fails to pay charges due to the Carrier in respect of any service rendered by the Carrier, the Carrier may detain and sell all or any of the goods of such person which are in his possession and, out of the moneys arising from the sale, retain the charges so payable an all charges and expenses of the detention and sale and shall render the surplus, if any, of the moneys arising from the sale and such of the goods remain unsold to the person entitled thereto.
9. A charge will be made by the Carrier in respect of any delay in excess of thirty minutes in loading or unloading occurring other than through default of the Carrier, such permissible delay period commencing upon the Carrier arrival/reporting for loading or unloading, labour for which purpose being the responsibility and at the expense of the Consignor or Consignee.
10. The Consignor shall specially declare and fully describe in writing the name and the nature and the value of all goods subject to special rates of carriage, or of a noxious, dangerous, hazardous, or inflammable nature or capable of causing damage or injury to any other goods, or to any persons or animals with which, or to any store, vessel, vehicle, wagon, van, aircraft or other conveyance of any kind whatsoever in which they may be loaded, carried packed or stored, or which are liquid or partly liquid, and additional freight charges shall be paid on such goods if deemed necessary by the Carrier.
11. Freight shall be considered earned whether the goods are delivered to the Consignee or not and whether damaged or otherwise. Under no circumstances will any payment for freight be refunded.
